This Service Agreement is made for the purpose of providing supports under the participant’s National Disability Insurance Scheme (NDIS) plan.
The Parties agree that this Service Agreement is made in the context of the NDIS, which is a scheme that aims to:
Support the independence and social and economic participation of people with disability.
Enable people with disability to exercise choice and control in the pursuit of their goals and the planning and delivery of their supports.
2. Schedule of Supports
The Provider agrees to provide the participant with the supports listed below. The prices listed are indicative and subject to the limits set out in the current NDIS Pricing Arrangements and Price Limits.

* Note: Prices typically increase on weekends, public holidays, and evenings in accordance with the NDIS Award. The Provider will charge the applicable rate at the time of service delivery.

3. Responsibilities
The Provider (Think Pathways) agrees to:
Provide supports that meet the participant's needs and preferred times (where possible).
Review the provision of supports at least every 3 months with the participant.
Communicate openly and honestly in a timely manner.
Treat the participant with courtesy and respect.
Keep accurate records on the supports provided to the participant.
Issue invoices and statements of the supports delivered to the participant.
The Participant agrees to:
Inform the Provider about how they wish the supports to be delivered to meet their needs.
Treat the Provider and staff with courtesy and respect.
Talk to the Provider if they have any concerns about the supports being provided.
Provide a safe environment for the Provider's staff (if services are delivered in-home).
Give the Provider the required notice if a scheduled appointment needs to be cancelled (see Section 5).
4. Payments and Invoicing
The Provider will seek payment for their provision of supports after the participant confirms satisfactory delivery.
How will payments be managed? (Select one)
Self-Managed: The Provider invoices the Participant directly. Payment is due within 7 days.
Plan-Managed: The Provider invoices the Plan Manager directly.
NDIA Managed: The Provider claims directly from the NDIA portal.
IF PLAN MANAGED - Plan Manager Details:
Travel and Transport Costs
Provider Travel: The Provider may claim travel time (labour) and non-labour costs (e.g. $1.00/km) for traveling to the participant, up to the limits specified in the NDIS Price Guide (typically 30 mins in metro areas).
Activity Based Transport: If the Provider transports the participant during the service (e.g. to the shops), the Provider will claim $1.00 per km for vehicle running costs, in addition to the hourly labour rate.

5. Cancellation Policy
Short Notice Cancellations
Think Pathways adheres strictly to the NDIS Pricing Arrangements and Price Limits. A cancellation is considered "Short Notice" if the participant:
Does not show up for a scheduled support within a reasonable time ("No Show").
Gives less than 2 clear business days' notice for a support that meets the NDIS definition.
In these events, the Provider may charge 100% of the agreed fee for the scheduled support.
6. Ending this Agreement
Either party may end this Service Agreement by giving the other party 14 days' notice in writing.
If either party seriously breaches this Service Agreement, the requirement of notice will be waived, and the agreement may be terminated immediately.

Feedback: The Participant can make a complaint or provide feedback by contacting Matisse Duffield at care@thinkpathways.com or by contacting the NDIS Commission.
Goods and Services Tax (GST): For the purposes of GST legislation, the Parties confirm that:
A supply of supports under this Service Agreement is a supply of one or more of the reasonable and necessary supports specified in the statement included, under subsection 33(2) of the National Disability Insurance Scheme Act 2013 (NDIS Act), in the participant’s NDIS plan currently in effect.
The supply is GST-free under section 38-38 of the A New Tax System (Goods and Services Tax) Act 1999.
